UOKiK investigation into food industry shrinkflation

Overview

The Polish Office of Competition and Consumer Protection (UOKiK) has launched explanatory proceedings against four major food manufacturers: Danone, Mondelez, Nestlé, and Unilever.

The investigation centers on ‘shrinkflation’, a practice where companies reduce the weight or volume of products while maintaining similar prices. UOKiK is examining whether these companies are adequately informing consumers of these changes. While manufacturers are legally required to list the correct mass or volume on labels, the regulator is investigating if the packaging design and graphics are deceptive by failing to clearly signal the reduction in size to customers.

UOKiK President Tomasz Chróstny noted that while downsizing is not inherently illegal, it becomes problematic if the presentation misleads consumers who rely on familiar packaging. The regulator is assessing whether the overall visual presentation could be considered deceptive. If such deception is determined, the authority may proceed with formal charges against the companies.
