Overview
Massachusetts Governor Maura Healey proposed legislation to cap resale prices at 110% of face value and limit secondary‑market fees to 10%. Included in the state’s supplemental budget, the measure aims to curb price gouging.
In the same week, Washington, D.C., enacted the RESALE Act, setting a 10% resale‑price ceiling, banning speculative sales and requiring sellers to own listed tickets.
By July 22, the Massachusetts “Great Divide Act” moved forward, retaining the 110% price cap, 10% fee limit and a ban on speculative “ghost” tickets, with backing from artists such as Noah Kahan, Aimee Mann, the Pixies and industry groups.
On July 26, Governor Healey announced the bill would also require written consent from artists or venues for any resale above the cap, and released a video featuring Noah Kahan endorsing the plan. Industry voices, including Ticket Policy Forum’s Brian Berry, warned that the legislation does not address primary‑sale pricing, which they say determines most ticket costs. State Senator Dylan Fernandes cited inflated resale listings for Kahan’s Fenway shows as illustration. The proposal remains pending a final vote in the Massachusetts General Court and continues to be watched as a model for other jurisdictions.
