US generic drug price-fixing settlement
Overview
A multistate coalition of 45 states and territories is seeking court approval for additional settlements with generic drug manufacturers to resolve allegations of a widespread conspiracy to manipulate prices and reduce competition.
Recent developments include agreements with Ascend Laboratories, Mayne Pharma, and Citron Pharma. Ascend and Mayne are expected to pay a combined $1.05 million to the states. The settlement with Citron Pharma is non-monetary, as the company has ceased operations. These new agreements include injunctive terms and internal reforms designed to ensure future antitrust compliance.
These developments follow previous settlements with companies such as Glenmark, Lannett, Bausch, Apotex, Heritage, Emcure, and Sandoz, which totaled $496.5 million. The coalition is also seeking a $400 million settlement involving Sandoz.
Consumers in the United States who purchased eligible generic medications—including treatments for cancer, diabetes, ADHD, and various topical conditions—between May 2009 and December 2019 may be entitled to compensation. To facilitate the process, forty-eight Attorneys General established a composite website for potential claimants to verify information and report claims. While many residents are eligible, specific restrictions apply to residents of Louisiana regarding settlement payments. The deadline for submitting claims is March 8, 2027.
