US state diesel fuel enforcement relief
Overview
In response to rising diesel fuel prices, governors in Alabama and Texas have implemented measures to support the agricultural, timber, and transportation sectors.
Alabama Governor Kay Ivey ordered a 120-day temporary suspension of enforcement regarding dyed diesel fuel to assist economic sectors impacted by fuel costs. The Alabama Law Enforcement Agency was instructed to adjust enforcement priorities, while the Alabama Department of Revenue was directed to request penalty relief from the IRS.
In Texas, Governor Greg Abbott issued a statewide disaster proclamation to address record-high diesel prices and supply shortages. This order suspends state restrictions and penalties for using dyed diesel on public roadways and waives state oversize and overweight permitting requirements for vehicles transporting fuel, agricultural, or timber products, allowing gross weights up to 95,000 pounds. Additionally, the Governor requested a temporary Clean Air Act waiver from the U.S. Environmental Protection Agency to address federal ultra-low sulfur diesel requirements and increase fuel availability.
A 30-day proclamation in Texas specifically aims to provide relief to the agriculture and freight industries by expanding the use of tax-exempt, red-dyed diesel on public roads. While the order allows for the use of dyed diesel, it does not waive the underlying 20-cent-per-gallon motor fuel tax. The Governor has also requested that the EPA waive Texas Low Emission Diesel (TxLED) rules to further boost supply.
