U.S. Supreme Court review of home distilling ban

Overview

The U.S. Supreme Court has agreed to review the constitutionality of an 1868 federal law that prohibits the distillation of spirits in private homes. The case, Department of Justice v. McNutt, centers on whether Congress exceeded its taxation powers when enacting the ban during the Reconstruction era.

The legal dispute highlights a split between federal appeals courts. The Fifth Circuit Court of Appeals ruled the ban unconstitutional, arguing it violates the taxation and necessary and proper clauses because it restricts activities rather than raising revenue. In contrast, the Sixth Circuit Court of Appeals upheld the ban as a necessary tool to prevent tax evasion.

Challengers, including the Buckeye Institute and Ohio brewery owner John Ream, argue the law is an antiquated relic. The federal government maintains the prohibition is essential to prevent producers from concealing operations in dwellings to evade excise taxes. Under current statutes, violators face up to five years in prison and fines of up to $10,000. A decision is expected by late June 2027.
