This action removes protections that expanded sexual discrimination coverage to include gender identity and sexual orientation in federally funded educational institutions. By revoking the 2024 rules, the administration has reinstated the 2020 regulatory framework from the first Trump administration. Education Secretary Linda McMahon stated the move aligns the federal regulatory code with court orders and congressional intent. The reinstatement returns the focus to biological sex in areas such as athletic competition and intimate facilities. The decision follows legal challenges and a Supreme Court ruling that allowed states to prohibit transgender women from participating in female school sports. While the 2024 protections for LGBTQ+ students are being removed, officials noted that the rescission does not yet include a new, explicit definition of sex. Officials noted that many schools had already been operating under the 2020 standards since January 2025 following judicial injunctions. The department proceeded with this formal rescission without a public notice and comment period, stating that doing so would be “contrary to the public interest.” In a recent White House speech, President Trump reiterated his stance on transgender issues, specifically targeting the participation of transgender women in female sports. The reversion to 2020 standards also introduces a more limited definition of sexual harassment and different due process protections for accused students.
