Vale mining safety and regulatory scrutiny in Brazil
Overview
Vale is facing increasing regulatory and legal scrutiny regarding mining safety and environmental management in Brazil.
In August 2026, the National Mining Agency (ANM) issued an embargo on Vale’s Maravilhas II tailings dam in Itabirito. The restriction, which prohibits new tailings deposits, was prompted by administrative irregularities, specifically the failure to update dam failure simulation studies and Emergency Action Plans following recent reinforcement works. While the ANM noted no immediate physical stability risks, the dam was placed on alert status.
By mid-September 2026, legal pressure intensified as the Federal Public Ministry (MPF) filed a civil public action against Vale, the ANM, and the Minas Gerais government. This action addresses environmental damages caused by the overflow of water and sediment at the Viga mine in Congonhas in January 2026. Following an inspection that found compromised infrastructure and a lack of proven operational safety, the ANM ordered a total shutdown of the mine.
Prosecutor Eduardo Henrique de Almeida Aguiar, representing the MPF, is requesting an independent technical audit funded by Vale to monitor environmental impacts and operational security. The MPF has also requested the freezing of R$ 200 million from Vale to guarantee reparations and the suspension of mining rights transfers. Vale stated it was unaware of the specific legal action but remains engaged in extrajudicial negotiations and discussions for an out-of-court settlement, noting that the company is taking measures for area recovery.
