Vorarlberg nature conservation law debate
Overview
The Vorarlberg provincial government has proposed the Nature Conservation Deregulation Act 2026, intended to simplify the Nature Conservation and Landscape Development Act by raising thresholds and shortening permit procedure times. Officials estimate the changes could eliminate 20 to 25 percent of current procedures.
Initial opposition from a coalition of eight nature conservation organizations, including BirdLife Vorarlberg and the Alpenverein, focused on the potential weakening of the nature conservation attorney’s role. Attorney Katharina Lins warned that the changes could exclude her office from approximately three-quarters of current proceedings.
As the review process progressed, legal scrutiny intensified with 202 individuals and institutions submitting statements. Concerns were raised by the Ministry of Agriculture regarding alignment with European Union law, the State Ombudsman regarding constitutional principles like equality, and the Vorarlberg Bar Association regarding the rule of law. Specific points of contention include reducing the protected shoreline zone from ten meters to five meters and limiting the rights of environmental advocates. While legal and environmental bodies have voiced opposition, the business sector, including the Chamber of Commerce and Industriellenvereinigung Vorarlberg, has expressed support for the regulatory changes.
