Netherlands introduces Wtta labor leasing regulations

Companies involved in labor leasing must register for a transitional arrangement under the Wet toelating terbeschikkingstelling van arbeidskrachten (Wtta) between November 1 and December 31, 2026. The law aims to prevent labor market abuses and unfair competition by requiring agencies, contractors, and payroll companies to hold specific permits or exemptions to provide personnel.

Starting January 1, 2028, enforcement will begin. Companies that fail to secure authorization or register for the transitional scheme risk being unable to lease personnel. Notably, both the agency providing the workers and the company hiring them could face penalties for non-compliance.

Research from Regioplan indicates that one-third of companies currently leasing personnel are unaware of these new requirements. This poses a significant risk to sectors heavily reliant on temporary labor, such as logistics and construction. Small agencies may face challenges due to the costs and inspections required to obtain permits, potentially leading to market consolidation or service disruptions.
