Netherlands labor leasing regulation implementation

Overview

The Netherlands is implementing the Wet toelating terbeschikkingstelling van arbeidskrachten (Wtta), a law designed to regulate the lending of labor. Under this legislation, entities such as employment agencies, payroll companies, and contractors must obtain authorization from the Dutch Labor Market Authority (NAU). A central component is the requirement for temporary workers to receive equal or equivalent pay and benefits compared to the permanent employees of the host company, covering twelve specific compensation elements including wages, allowances, and pension schemes.

As the implementation progresses, new requirements have emerged regarding time registration, necessitating verifiable records of work locations, unpaid breaks, and start and end times. Failure to comply with these standards may result in the suspension or revocation of licenses. While the Dutch Labor Inspectorate will enforce these rules, potential fines for non-compliance were noted to reach €110,000 in 2026.

A transitional registration period for lenders is scheduled to run from November 1 through December 31, 2026. From January 1, 2028, companies may only hire lent personnel from authorized providers, and enforcement will intensify. Research from Regioplan indicates that approximately one-third of companies currently leasing personnel are unaware of these new requirements, posing risks to sectors like logistics and construction. Additionally, small agencies may face challenges due to the costs of permits and inspections, which could lead to market consolidation.
