AI integration and legal challenges in German judiciary

The German judiciary is navigating the integration of artificial intelligence, facing both systemic challenges and technological advancements.

Christine Fuchsloch, President of the Federal Social Court (Bundessozialgericht), warned of a potential judicial blockade caused by a surge in AI-generated legal filings. These documents are often described as excessively long, disorganized, and containing citations of “invented, irrelevant, or outdated court decisions.” This issue is particularly acute in emergency proceedings, which saw a roughly 50 percent increase in many federal states in 2025, threatening to delay main proceedings and undermine social court functionality.

In response to broader digitalization needs, judicial authorities are implementing supportive AI and cloud infrastructure. In Brandenburg, the juris KI-Suite is being deployed to assist staff with legal research by linking case law and statutes. Following a four-week trial, Minister Benjamin Grimm emphasized that the technology is intended to “support rather than replace staff,” with final assessments remaining the responsibility of humans. Additionally, efforts to establish a nationwide justice cloud are underway, with states like Baden-Württemberg and Lower Saxony already connecting to the network to standardize software usage. A first version of this cloud infrastructure is expected by mid-2027.

Beyond procedural issues, the German legal system is addressing the intellectual property implications of AI. The Federal Court of Justice (BGH) is set to deliberate on a landmark copyright case involving the provider LAION. The dispute, initiated by a professional photographer, will help determine the legal boundaries of text and data mining and whether copyrighted works can be used to train AI models without explicit permission.
