Aneel energy auction dispute in Brazil

Overview

Evolution Power Partners (EPP) has challenged the National Electric Energy Agency (Aneel) regarding a capacity reserve auction. EPP requested that Aneel disregard documents submitted by Eneva and Global Participações em Energia, alleging they were provided after the established deadline following the disqualification appeal of the ION consortiums.

The dispute involves thermal power projects totaling 1,685 MW. The Permanent Auction Commission recommended disqualifying the ION consortiums due to alleged failures in proving economic-financial capacity and potential double-counting of assets. While Eneva provided a KPMG analysis to support its position, EPP has contested the scope of that work, stating it did not audit the accounting records of the ION consortiums. A final decision on the appeal remains with Aneel’s collegiate board.
