Argentina CNV financial and virtual asset regulation
Overview
The Argentine National Securities Commission (CNV) has initiated several regulatory updates aimed at modernizing market oversight and virtual asset management.
In mid-October 2026, the CNV opened a public consultation to reform regulations regarding material facts. The proposal seeks to categorize material facts into managerial, administrative, financial, and judicial matters, while introducing quantitative thresholds based on net equity or income to determine reporting requirements. The reform also intends to explicitly include cybersecurity or technological incidents as material facts. The proposed resolution aims to clarify the conditions that constitute a material fact and reformulate the treatment of information disclosed by third parties or rumors, requiring that all communications be “truthful, clear, and neutral”.
Concurrently, the CNV implemented General Resolution 1172/2026, establishing a new framework for virtual asset service providers (VASPs) effective October 16, 2026. These rules align with FATF standards by prohibiting mixers, mandating monthly reporting, and requiring strict identity verification and fund tracking. VASPs must now ensure the separation of client and company assets, provide proof of reserves, and report security incidents or losses exceeding 15% of net equity.
Under the new resolution, VASPs must meet minimum net worth requirements ranging from USD 35,000 to USD 150,000, depending on their category. The framework also reinforces cybersecurity obligations, including annual system audits and specific protocols for private key custody, such as multi-signature and cold storage. Starting November 1, 2026, providers must submit monthly reports via the Financial Information Highway (AIF) detailing client numbers, transaction volumes, and assets under custody.
