Austrian corporate and private insolvency trends

Overview

Insolvency trends in Austria have shown significant activity in both the corporate and private sectors through the first three quarters of 2026. Corporate insolvencies have remained relatively stable, though recent data indicates a slight decrease in total proceedings compared to the previous year. Despite this, a critical issue persists regarding the ability of businesses to enter formal proceedings. Approximately 43 percent of corporate insolvency filings—roughly 2,204 cases—were rejected because companies lacked the minimum 4,000 euros required to cover opening costs, representing a significant increase in rejected cases.

The retail, construction, and gastronomy sectors continue to see the highest frequency of filings. While the real estate sector accounted for the largest volume of insolvencies by total liabilities, including Signa-related companies, the human impact is rising, with an estimated 15,700 employees and 36,300 creditors affected.

Regional data highlights a worsening situation in Styria. In this state, private debt restructuring proceedings rose by 19.1 percent during the first nine months of 2026, reaching 822 cases. This surge, alongside corporate increases, is attributed to rising living costs, inflation, and the expiration of a three-year debt relief option in mid-July. In Styria, corporate insolvencies also rose by 18 percent, with total liabilities surging by nearly 165 percent to approximately 735 million euros.

Simultaneously, private insolvencies have experienced a sharp increase. Nationwide, debt settlement proceedings have risen significantly, driven by a strained economic climate and the aforementioned legal changes regarding debt relief.
