In response to these sophisticated criminal structures, the Brazilian Senate approved Bill PL 1482/2019. This legislation increases penalties for the theft and robbery of petroleum, natural gas, biofuels, and lubricants. The law targets the entire supply chain, establishing prison sentences of up to 10 years for theft and up to 8 years for those who acquire, transport, or sell stolen products. Penalties may increase if the act causes supply shortages, fires, environmental damage, or death.

Complementing legislative efforts, consumer protection agencies have intensified field inspections to monitor for ‘low pumps’ and excessive alcohol content.

Further legislative action has been introduced via Bill 2456/26, proposed by Deputy Pastor Gil. This bill seeks to combat commercial fraud, fuel diversion, and volumetric adulteration by mandating that all containers, drums, and vessels used for storing or transporting liquid fuels feature a ‘visible, permanent, and indelible marking’ of their nominal volumetric capacity. Under this proposal, the National Institute of Metrology, Quality and Technology (Inmetro) would regulate technical standards, while the ANP and state Military Fire Departments would oversee enforcement. Non-compliance could result in fines up to R$ 500,000, seizure of containers, and suspension of commercial activities.
