Brazil vehicle protection regulatory changes

Overview

The Brazilian vehicle protection and insurance market is undergoing regulatory shifts. Under Complementary Law 213/2025 and CNSP Resolution No. 491, new rules are establishing stricter requirements for vehicle protection associations. These include mandates for operational authorization, minimum capital maintenance, and the creation of reserve funds to guarantee claim payments.

Furthermore, these associations will now fall under the direct supervision of the Superintendency of Private Insurance (Susep), which is linked to the Ministry of Finance, in an effort to increase transparency and governance. Currently, approximately 30% of the Brazilian vehicle fleet is covered by insurance or protection models.
