Brazilian judicial investigations and court orders
Overview
In Brazil, Supreme Federal Court (STF) ministers have authorized several high-profile judicial operations involving investigations into corruption and the use of official resources.
Minister Flávio Dino ordered search and seizure measures against Ulisses Rabaneda, a counselor of the National Council of Justice (CNJ), as part of an investigation into a suspected R$ 308 million embezzlement scheme related to an agreement between the telecommunications company Oi and the state of Mato Grosso. The operation included freezing assets up to R$ 316 million and seizing passports.
Minister Alexandre de Moraes authorized Federal Police operations targeting individuals suspected of being sources for journalist Luís Pablo Conceição Almeida. The investigation concerns reports regarding the alleged irregular use of official vehicles by the family of Minister Flávio Dino. Recent warrants have been issued against Raimundo Cutrim, a former Maranhão government secretary, and Diogo Diniz Lima. Authorities are investigating allegations that Cutrim used restricted access systems to obtain information and footage for the journalist, as well as suspicious financial transactions involving R$ 100,000.
This has sparked a significant debate regarding press freedom. Moraes argued that constitutional source confidentiality cannot serve as a shield for criminal activities, such as illegal monitoring. Conversely, journalist Luís Pablo has denied monitoring Dino, claiming the operation threatens professional integrity. The Inter-American Press Association (SIP) described the measures as a ‘grave threat’ and a ‘dangerous precedent’ for Brazilian journalism.
STF President Edson Fachin expressed solidarity with Minister Dino regarding threats to his family's safety but emphasized that judicial inquiries must target specific criminal conduct and never infringe upon legitimate journalistic activity. Fachin indicated that the court's plenary may review the decision to identify the journalist's source.
