Brazilian judicial proceedings against Oswaldo Eustáquio

Overview

The Brazilian Supreme Federal Court (STF) has moved forward with criminal proceedings against blogger Oswaldo Eustáquio. Initially, Justice Alexandre de Moraes voted to accept a criminal complaint from the Prosecutor General’s Office (PGR) alleging that Eustáquio participated in a criminal association to undermine the 2022 electoral system and the democratic rule of law.

The PGR claims Eustáquio used social media to encourage opposition to President Luiz Inácio Lula da Silva’s inauguration and to promote actions that preceded the January 8, 2023, attacks on government buildings in Brasília. While Eustáquio criticized the proceedings as a “media fabrication,” the court’s First Panel ultimately voted unanimously to indict him for criminal organization.

The indictment allows the case to proceed to the criminal instruction phase for further evidence gathering. Eustáquio, a supporter of former President Jair Bolsonaro, has been a fugitive from Brazilian justice since 2023 and is currently residing in Spain.
