Brazilian judicial suspensions of local officials

Overview

Brazilian judicial authorities have issued several injunctions to suspend the removal of local officials from office pending further legal review.

In Goiânia, the National Council of Justice (CNJ) suspended the removal of councilwoman Aava Santiago after a regional court revoked her mandate due to allegations of party infidelity. The suspension followed defense claims regarding the “improper use of Artificial Intelligence” in the court’s decision, which allegedly contained passages resembling internal AI instructions. The CNJ has requested clarifications from the Regional Electoral Court of Goiás.

In other regions, courts have halted similar proceedings. In São Paulo, an impeachment process against councilman Getúlio de Carvalho Filho was suspended to verify the legal legitimacy of the accusers. In Paraíba, a minister of the Superior Electoral Court (TSE) suspended the removal of Areia Mayor Silvia Cesar Farias da Cunha Lima and Vice-Mayor Luiz Francisco dos Santos Neto, who had been stripped of their mandates over allegations of vote-buying and abuse of power. The TSE noted that immediate removal could cause “irreversible institutional consequences,” such as necessitating supplementary elections.

Entities
