Overview

As Brazil approaches the 2026 elections, several states are implementing varying public security measures regarding the sale of alcohol, known as ‘Lei Seca’. Because there is no single federal mandate from the Superior Electoral Court (TSE), regulations are determined by individual state Regional Electoral Courts (TREs) and security secretariats.

Eight states—Acre, Amazonas, Amapá, Maranhão, Pará, Piauí, Roraima, and Ceará—have implemented full-territory restrictions. In Pará, the Civil Police have prohibited the sale, distribution, and supply of alcohol from 0:00 to 18:00 during both voting rounds, while also suspending musical performances and public events. In Piauí, officials reduced a planned 24-hour ban to an 18-hour window (0:00 to 18:00) following a request from the Brazilian Association of Bars and Restaurants (Abrasel). Mato Grosso has also established a uniform rule for its entire state, prohibiting alcohol from 7:00 to 16:00.

Other states have applied more localized measures. In Goiás, 53 municipalities established autonomous restrictions through local judges, though major cities like Goiânia remain unrestricted. States including Bahia, Tocantins, Sergipe, and Rondônia have applied restrictions only to specific electoral zones or municipalities.

Conversely, several major states will allow the sale of alcoholic beverages, including São Paulo, Minas Gerais, Rio de Janeiro, Paraná, Espírito Santo, Santa Catarina, Paraíba, Pernambuco, Mato Grosso do Sul, and Rio Grande do Norte. In Alagoas, the State Public Security Secretariat revoked a previous ordinance, allowing normal commercial activity throughout the voting day following requests from the hospitality and gastronomic sectors. Violating these local determinations can lead to charges of disobedience under the Electoral Code, as the primary objective is to maintain public order and security near polling stations.
