California death penalty clemency advocacy

The California Anti-Death Penalty Coalition, supported by over 200 organizations and exoneree Shujaa Graham, has urged Governor Gavin Newsom to grant universal clemency to the 578 inmates currently on death row. Activists staged a demonstration at the state Capitol to argue that the death penalty is racially biased and carries the risk of executing innocent individuals.

As Newsom’s term approaches its conclusion, he faces decisions regarding the commutation of sentences for 547 men and 18 women on death row. While the Governor has previously expressed a commitment to ending capital punishment and has worked to dismantle lethal injection protocols, observers suggest that a mass commutation could influence his political future. Additionally, the Governor’s influence extends to individual parole cases, such as that of Joseph Tidwell, whose upcoming parole has prompted calls for intervention.

With Newsom preparing to leave office in January, advocates and international human rights groups are intensifying calls for a mass commutation of all death sentences. Such a move would convert death sentences to life in prison, protecting inmates from future governors who may favor capital punishment. A mass commutation would reduce the total number of people under death sentences in the U.S. by more than 25%.

However, Newsom faces significant legal constraints. Unlike a president, he cannot act entirely alone; the California Supreme Court must approve commutations for individuals with multiple felony convictions, a condition that applies to more than half of the relevant cases.
