Chilean pension funds face legal and regulatory scrutiny

Overview

Chilean pension fund administrators (AFPs) are facing intense scrutiny following substantial valuation losses, which the Superintendencia de Pensiones reported reached more than $10 billion as of September 30, 2026. This revised figure significantly exceeds previous estimates of $7.7 billion, as it now incorporates transactions made with both foreign and local financial institutions in addition to foreign bank swaps.

Fund E, the system’s most conservative tier, recorded a real negative return of approximately 10.39% between January and September 2026. León Fernández de Castro, president of the Association of AFPs, testified before the Chamber of Deputies that while these losses are significant, they are not expected to result in an equivalent reduction in pension amounts; the projected impact on retirements is estimated at 0.8% for women and 1.8% for men.

The crisis has escalated into administrative, criminal, and political action. The Superintendencia de Pensiones has launched sanctioning proceedings against all seven operating AFPs—Capital, Cuprum, Habitat, Modelo, PlanVital, Provida, and Uno—to investigate potential breaches of the duties of loyalty and diligence. Superintendent Joaquín Cortez noted that regulatory warnings regarding the increasing use of interest rate swaps and derivatives began in late 2024.

In Congress, Deputy Jaime Araya has secured the 62 signatures required to request an investigative commission to examine administrator decisions and regulatory performance. Furthermore, Chilean lawmakers have filed criminal complaints alleging ‘potentially unlawful administration,’ while experts have called for investigations into whether boards of directors fulfilled their fiduciary duties of care and supervision.
