China ecological environment legal codification
Overview
China is transitioning its legal landscape from fragmented single laws toward a systematic, integrated legislative framework. This process involves the implementation of comprehensive codes, following the model of the Civil Code, which utilizes a phased legislative strategy and a structure of “general principles + sub-chapters” to manage complex reforms.
The Chinese approach to codification emphasizes constitutional leadership, integrating social values—such as core socialist values and the concept of harmony between humanity and nature—directly into the legal text. This model aims to transition from rigid control to precise governance, addressing issues ranging from carbon neutrality to local concerns like restaurant smoke.
On August 15, 2026, China officially implemented the Ecological Environment Code, the world’s first code specifically named for the ecological environment. This landmark legislation serves as a comprehensive integration of over 30 existing environmental laws, 100 administrative regulations, and more than 1,000 local regulations. Comprising 1,242 articles, the code is centered on three pillars: pollution prevention and control, ecological protection, and green, low-carbon development.
Following the code’s implementation, China held major events for the 2026 National Ecology Day in Inner Mongolia and Yantai, Shandong province. In Inner Mongolia, officials highlighted ecological security achievements, such as a 26% decrease in energy consumption intensity since the 18th National Congress. In Yantai, efforts focused on industrial transitions through the development of clean energy bases and the use of “Huanbao,” an AI-driven large model designed to assist with carbon emission accounting. These initiatives align with China’s goals for the upcoming “15th Five-Year Plan” to deepen green industrialization and strengthen ecological security barriers.
