The tribunal ordered Microsoft to reactivate the account, restore every purchased game within 15 days, and imposed daily fines for non‑compliance, together with a US$400 moral‑damage award. The judgment rejected Microsoft’s claim that digital purchases are merely licences and is being cited globally as a precedent for digital‑goods ownership rights.
A follow‑up decision on 13 July specified a daily fine of 150 reais (≈$30), capped at 1,500 reais, confirmed the 2,000‑real moral‑damage award and added a 10 % penalty for late payment. The small‑claims court highlighted that the hack occurred despite the user’s two‑factor authentication and noted Microsoft’s denial of access to the player’s OneDrive files, reinforcing consumer‑protection claims over both game libraries and associated cloud data.
Together these rulings illustrate a growing Brazilian and international focus on consumer‑protection across the gaming ecosystem—from loot‑box gambling concerns to the security and ownership of digital content—prompting further legal actions, tighter regulations and heightened public scrutiny.
