Overview

In Mexico, judicial and legislative efforts to secure the rights of indigenous and Afro-Mexican communities continue to evolve. The Supreme Court of Justice of the Nation (SCJN) has reinforced the principle of self-identification and expanded the legal standing of these communities by recognizing them as “third parties of interest” in constitutional controversies.

Legislative progress is advancing through the consultation process for a new General Law on the Rights of Indigenous and Afro-Mexican Peoples (LGDHPIA). However, the Mesoamerican Indigenous Observatory (OIM) has criticized the federal government’s consultation process, characterizing it as a “simulation” intended to legitimize pre-determined state interests. The OIM argues the 453-article proposal contains legal constraints that could undermine the autonomy of indigenous territories by potentially treating them as areas of public utility.

During consultations organized by the National Institute of Indigenous Peoples (INPI) in Oaxaca, religious leaders, including Pastor Porfirio Flores, have advocated for the law to decouple civil community responsibilities from Catholic religious practices to protect evangelical citizens from harassment, property seizure, and forced displacement.

In a recent landmark ruling, the SCJN addressed the intersection of state criminal law and indigenous jurisdiction. In a 7-1 decision, the Court ruled that criminal control judges must first define the legal status of detainees—specifically through a formal link to the criminal process—before deciding whether to transfer jurisdiction to traditional community authorities. The ruling follows a 2024 incident in Santiago Yucuyachi, Oaxaca, involving Mixtec defendants. While the majority held that establishing legal status does not preclude transferring cases to indigenous authorities, dissenting Minister Hugo Aguilar argued that prioritizing state procedural requirements could undermine constitutional recognition of indigenous self-determination.
