Italian environmental and remediation legislative updates
Overview
The Italian government has introduced legislative measures to advance environmental remediation, the circular economy, and climate change management.
Initially, the government approved the Ambiente-bis decree, which allocated 200 million euros for remediating the Terra dei Fuochi area in Naples and Caserta, appointing General Giuseppe Vadalà as Government Commissioner. This package also included investments in water infrastructure via the PNRR across Puglia, Campania, and Tuscany, alongside urban regeneration projects in Messina.
Subsequently, the government published Decree Law 177/2026, which entered into force on October 9, 2026. This law focuses on strengthening environmental assessments and land remediation, specifically introducing new regulations for the construction sector regarding the management and temporary storage of excavated earth, rocks, and waste.
On October 20, 2026, Stefano Betti of the National Association of Construction Companies (ANCE) testified before the Chamber of Deputies' Environment Commission to advocate for the conversion of this decree. Betti urged Parliament to confirm simplifications designed to accelerate environmental procedures and strengthen the circular economy. He argued that excavated materials should be treated as “reusable resources rather than waste” to reduce transport needs and CO2 emissions. Betti also supported Article 185-ter, which proposes a 20 cubic meter threshold for small construction sites to reduce administrative burdens, and noted the decree’s limits for temporary storage, set at 4,000 cubic meters, with a maximum of 800 cubic meters for hazardous waste.
