Legal risks for Serbian and Bosnian citizens in Croatia

Overview

The Veritas information center has issued warnings to Serbian and Bosnian citizens traveling to Croatia regarding legal risks associated with their social media content. Savo Štrbac, director of Veritas, noted that individuals could face fines between 500 and 4,000 euros for posts deemed controversial by Croatian authorities. One cited instance involved a citizen fined 1,500 euros for posting a photo of Ratko Mladić on Facebook.

Subsequent details clarify that social media activity on platforms such as Facebook, Instagram, and TikTok—specifically content viewed as “disturbing public order and peace” or the “glorification of war criminals”—can trigger both judicial and administrative proceedings. Veritas reports that specialized services within the Croatian border and internal police monitor these profiles, often retroactively reviewing past posts and stories.

Beyond judicial fines or suspended sentences, the Croatian Ministry of the Interior may use administrative procedures under the Law on Foreigners to issue expulsion orders. These orders can result in bans from the European Economic Area, including the EU, Norway, Iceland, and Liechtenstein, for durations of three months to one year. Such bans are recorded in the Schengen Information System (SIS), effectively blocking access to the entire European Union. Recent incidents involving the arrest of footballer Branislav Joke and the prosecution of artist Svetlana Spajić have underscored these risks.
