In July 2026, the Lower Saxony parliament amended the Niedersächsisches Kommunalwahlgesetz to allow election committees to consult intelligence reports when assessing a candidate’s commitment to the free democratic order. The state interior ministry, led by Daniela Behrens, used this “constitution-loyalty” test to bar several AfD candidates ahead of the 13 September municipal elections. On 22 July, the six-person election committee excluded AfD Bundestag member Martin Sichert from the Friesland district-administrator race. The same day, the committee reviewed AfD deputy leader Stephan Bothe’s candidacy for Lüneburg landrat. On 29 July, Bothe was officially rejected by the Lüneburg district election committee in a 6-1 vote, a decision he described as a “back-door ban.” A 25 July report confirmed that candidates such as Martina Hartschwager, Thorsten Moriße, and Justin Vogel were also excluded, prompting UN special-rapporteur Irene Khan to label the practice “not in line with international standards.” On 1 August, former Constitutional Court president Hans-Jürgen Papier warned against a “small-party ban” of the AfD, noting that indirect exclusions risk undermining constitutional party privilege. On 6 August, details emerged that the committee followed the interior ministry’s recommendation for several barred figures, including Bothe, Moriße, Vogel, and independent Eugen Nazarenus, while others like Jessica Schülke remained on the ballot. AfD lawyer Christian Wirth characterized the procedure as a “Lex AfD.” On 17 August, the Administrative Court of Lüneburg rejected Stephan Bothe’s urgent application to be admitted as a candidate, ruling the application inadmissible because election procedure decisions are generally subject to review through an election scrutiny process after the vote. On 4 September, the Higher Administrative Court (OVG) in Lüneburg issued a final ruling barring Stephan Bothe, Martin Sichert, and Justin Vogel from the September 13 elections.
