Maxaranguape mayoral mandate legal dispute

Overview

The Regional Electoral Court of Rio Grande do Norte (TRE-RN) unanimously upheld the cassation of Maxaranguape’s mayor, Maria Erenir Freitas de Lima (Professora Nira), and vice-mayor Evanio Pedro do Nascimento. The court found the officials guilty of abusing political and economic power by distributing construction materials to vulnerable voters during the 2024 municipal election.

Following this ruling, the officials were ordered to vacate their posts, and Councilwoman Daya Sobrinho assumed the mayoralty on an interim basis pending a supplementary election.

However, a justice of the Superior Electoral Court (TSE) subsequently suspended the removal of the mayor and vice-mayor. Justice André Mendonça ruled that removing the administrators before a final analysis of their appeal was premature, citing the significant electoral margin held by the duo and the relatively small number of families involved in the alleged misconduct. This decision allows the officials to reassume their positions while the special appeal is pending.
