Mexican legal reforms regarding child support debtors

Overview

Legislative and political entities in Mexico are implementing measures to penalize individuals who fail to meet child support obligations.

In Oaxaca, the LXVI Legislature approved reforms to the State Family Code. These regulations impose administrative and legal restrictions on individuals listed in the State Registry of Delinquent Child Support Debtors. Penalties include the inability to obtain or renew driver’s licenses, restrictions on performing notary acts for real estate transactions, and prohibitions against running for elective office or judicial positions. Additionally, civil registry officials must now disclose debtor status during marriage applications.

In Hidalgo, the Morena party announced it will bar child support debtors and perpetrators of violence from seeking political office in upcoming elections. This follows a 2025 reform to the state’s Electoral Code and subsequent changes to Family Law intended to make the Registry of Child Support Debtors public. Under these rules, individuals who fail to meet responsibilities for more than 90 days are included in the registry.
