Moroccan judicial system reforms and performance
Overview
The Moroccan judicial system has reported significant improvements in efficiency and case management. Data from the Supreme Council of the Judicial Power and the Ministry of Justice indicate that in 2025, courts achieved a clearance rate of 101.8%, with the number of pending cases decreasing by 12.42% to 506,074. The average time to resolve pending cases also dropped to 45 days.
A key component of this progress is the increased use of reconciliation procedures as an alternative to public prosecution. In the first nine months of 2026, approximately 40,000 cases were settled through reconciliation, an 80% increase over the previous year, contributing roughly 30 million dirhams to the state treasury.
Building on these developments, Minister of Justice Abdellatif Ouahbi has announced plans to overhaul commercial legislation and expand judicial infrastructure. To address delays caused by complex procedures, new commercial law departments and courts are planned for Oujda, Rabat, and Laâyoune. Further legislative proposals regarding commercial codes and obligations are expected in 2027 following stakeholder consultations.
In late 2026, judicial officials began participating in specialized training sessions to support these reforms. In Marrakech, public prosecution judges attended sessions regarding Law No. 66.23, which regulates the legal profession, led by officials including Prosecutor General Khalid Kerdoudi. Additionally, the Higher Institute of the Judiciary in Rabat launched a program for new officials focused on modern judicial administration, including results-based management, strategic court planning, and the optimization of judicial time.
