New York City is experiencing legal and regulatory scrutiny regarding its rent stabilization policies. Initially, legal challenges emerged against a rent freeze implemented by the Rent Guidelines Board, with landlords arguing the board failed to meet its statutory mandate. Concurrently, the real estate brokerage Compass faced a class action lawsuit alleging it used its market share to create a “fake supply shock” by delisting rental units from free platforms to artificially inflate rents.

The situation escalated as investigations turned toward potential collusion between the Mayor’s administration and the Rent Guidelines Board. Following the board's decision to freeze rents on approximately 1 million units, a judge ordered city officials to release communications to determine if Mayor Zohran Mamdani improperly influenced the board. The inquiry follows allegations from landlords that the Mayor stacked the board with loyalists, with the court noting it is “unprecedented” for a mayoral candidate to guarantee specific board outcomes to voters.

Recent developments have intensified these allegations following a 7-1 vote by the Rent Guidelines Board to freeze rents on one and two-year leases, fulfilling a key campaign promise by Mayor Mamdani. The board’s independence has been called into question after the resignation of member Christina Smyth, who claimed the board had ceased to be a “fact-finding body” and was instead rebuilt to ensure a specific outcome, describing public hearings and data collection as “theater.” Critics note that of the nine board members, six were appointed by Mamdani.

Beyond the rent freeze litigation, the Mamdani administration is facing separate lawsuits regarding the handling of public records, with critics and organizations like the Manhattan Institute alleging excessive delays in fulfilling Freedom of Information Law requests.
