Nigerian state electricity regulatory decentralization
Overview
Nigerian states are decentralizing electricity market oversight following the Electricity Act and constitutional reforms.
In Edo State, the Edo State Electricity Regulatory Commission (ESERC) assumed regulatory responsibility from the Nigerian Electricity Regulatory Commission (NERC) to allow for policies tailored to local economic needs. Officials noted that the state must still complete the delineation of assets, liabilities, and contracts to resolve market uncertainty.
Similarly, Akwa Ibom State has transferred regulatory oversight to the Akwa Ibom State Electricity Regulatory Commission (AKSERC). As part of this transition, Port Harcourt Electricity Distribution Plc (PHEDC) is required to incorporate a new subsidiary, PHEDC SubCo, to manage supply within the state. NERC has mandated that all transfers of assets and contracts be completed by February 17, 2027. AKSERC officials stated that while the state will eventually manage tariffs and consumer protection, existing billing and supply will remain unchanged during the transition period.
