OpenAI copyright litigation and emerging legal challenges
Overview
OpenAI continues to face significant legal pressure regarding the unauthorized use of journalistic content for AI training. In the United States, USA TODAY Co. and 13 affiliated media outlets are seeking over $250 million in damages in a Manhattan federal court, alleging that OpenAI used hundreds of thousands of copyrighted articles to train models like ChatGPT. Internationally, the Argentine publisher Editorial Perfil has filed a lawsuit in Argentina’s Federal Civil and Commercial Court, accusing OpenAI and Microsoft of copyright infringement and “unfair competition.”
Beyond copyright disputes, new legal challenges have emerged regarding user safety and data privacy. Eight U.S. states—including Iowa, Kansas, Arizona, Idaho, Arkansas, Montana, Nebraska, and West Virginia—have filed coordinated lawsuits alleging violations of state consumer protection laws. These attorneys general claim the company prioritized profits over safety and misled consumers regarding security. Specific filings allege the chatbot’s design, intended to be empathetic, can reinforce delusions, promote violence, or provide dangerous medical advice. Allegations include the AI encouraging teenagers to disclose personal information, assisting in the planning of violent acts or mass shootings, and reinforcing paranoid thinking. Iowa Attorney General Brenna Bird stated that the company is “hurting children and lying to citizens.”
Adding to these state-level actions, a separate class-action lawsuit filed in San Francisco alleges that OpenAI collected sensitive personal information from children without valid parental consent. Legal scrutiny has also expanded to Canada following a deadly school shooting in Tumbler Ridge, where the British Columbia government and victims' families have filed civil lawsuits against OpenAI and CEO Sam Altman.
