Poland digital business and taxation mandates
Overview
Poland is advancing digital administrative and taxation requirements for businesses. The government is implementing the KSeF mandatory B2B e-invoicing system, with large companies required to use it by February 1, 2026, and all other businesses by April 1, 2026. Notably, the requirement to receive invoices through the KSeF API begins for everyone on February 1, 2026. Small sellers with monthly gross sales of 10,000 PLN or less are exempt from the issuance requirement until the end of 2026. While automatic penalties for technical errors are deferred until 2028, businesses must comply with the legal obligation to use the system.
In addition to e-invoicing, entrepreneurs registered in the CEIDG before January 1, 2025, must have an active electronic delivery address (ADE) by October 1, 2026. Under this e-Delivery system, digital letters hold the same legal weight as registered mail. A critical rule dictates that a document is considered delivered 14 days after it arrives in the inbox, regardless of whether it has been opened.
Further digitalization mandates affect business registration. Starting November 1, 2026, CEIDG applications must be submitted exclusively online via the Biznes.gov.pl portal, the mObywatel application, or various banking platforms using digital identity tools such as Profil Zaufany, an e-Dowód, or a qualified electronic signature. Municipal offices will no longer accept paper applications for starting a business. The only exception to this mandate applies to minors, who may continue to use traditional paper methods until October 31, 2028. Additionally, starting January 1, 2027, businesses must include the KSeF number in the title of bank transfers. Further mandates expected by November 2028 will require all changes, suspensions, or terminations of business activities to be conducted exclusively online.
