Poland‑Pfizer vaccine dispute and ATC funding freeze
Entities: Poland · Pfizer Inc. · Prosecutor General of Poland · Ministry of Health (Poland) · Eurocontrol
Overview
In June 2026 a Belgian first‑instance court ordered Poland to accept about 64 million unused COVID‑19 vaccine doses and to pay more than 5.6 billion zł to Pfizer‑BioNTech, including a 3 % registration tax and related costs. Poland was given 60 days to file an appeal. The Ministry of Health prepared legal arguments and the finance ministry questioned the legality of the tax.
On 30 July 2026 Pfizer froze billions of dollars earmarked for air‑traffic‑control funding in Poland and Romania, citing the same judgment, which also obliges Romania to pay roughly $640 million. Eurocontrol warned the freeze could jeopardise flight safety; the Polish Air Navigation Agency said operations remain safe. Prime Minister Donald Tusk pledged an emergency allocation of about 1 billion zł to sustain navigation services while the legal objection proceeds. The Belgian court rejected Poland’s request to postpone enforcement.
On 3 August 2026 Poland formally appealed the ruling, seeking a stay of execution and arguing that the original decision omitted important factual and legal circumstances. The appeal is supported by the Prosecutor General and specialised law firms. Legal observers continue to criticize Pfizer’s enforcement tactics as “outrageous and unethical,” while the company maintains it is exercising contractual rights.
