Regulation of aesthetic medicine and professional intrusion
Overview
Concerns regarding professional intrusion and the lack of regulation in the aesthetic medicine sector have emerged in both Spain and Mexico.
In Spain, the Spanish Society of Aesthetic Medicine (SEME) reported that while 46% of the population has undergone aesthetic treatments, approximately 44% of users are unaware that such procedures must be performed exclusively by registered medical doctors in licensed clinics. SEME warned that patients are increasingly seeking services in unauthorized locations like hair salons or gyms, noting that young adults may prioritize low costs over safety.
In Mexico, legislative action has been proposed to address similar issues. Senator Simey Olvera Bautista introduced a reform to the General Health Law following reports from the Federal Commission for Protection against Sanitary Risks (Cofepris) showing a 3,950 percent increase in the closure of irregular plastic surgery clinics. The proposal seeks to classify performing medical-surgical procedures without proper training or certification as the crime of “professional usurpation” under the Federal Penal Code.
