Regulatory actions against Ejesa electricity utility

Overview

The Superintendency of Public Services and Other Concessions (Susepu) has taken regulatory action against the electricity distributor Ejesa in Jujuy, Argentina, regarding billing and service quality.

Initially, Susepu mandated that Ejesa restructure its electricity billing schedule to prevent overlapping due dates that could cause financial strain for consumers. To assist with this transition, Ejesa allowed users to pay a second September deadline by October 10, 2026, without late interest.

Following an audit of power supply performance from January to June 2023, Susepu imposed a fine exceeding 1 billion pesos on Ejesa via Resolution 296-SUSEPU/2026. Technical inspections revealed that the frequency and duration of power outages in urban, rural, and isolated systems, including Piedra Negra and Susques, exceeded limits permitted by the company’s concession contract.

The final fine, totaling $1,011,803,847.11, was calculated by applying an update coefficient to an initial base penalty of $427,999.58. Rather than being paid to the state, these funds must be returned directly to affected users as credits on their billing statements. Ejesa has been granted 15 business days to submit a detailed list of affected clients and locations to Susepu.
