Legal dispute: Rotterdam councilor vs Wim Beelen
Overview
Rotterdam city council member Kevin van Eikeren faced legal action following his use of derogatory terms such as ‘proleet’, ‘patjepeeër’, and ‘hardcore speculator’ to describe entrepreneur Wim Beelen.
A court subsequently ordered Van Eikeren to issue a formal rectification regarding his claims. The judge ruled that Van Eikeren’s statements, which included accusations that Beelen attempted to bribe political parties and intended to build expensive housing on an amusement park site, were unlawful and lacked factual substantiation. While the court declined Beelen’s requests for a ban on future claims and specific financial penalties, Van Eikeren was mandated to post the rectification on his Instagram and LinkedIn channels within 72 hours. Van Eikeren indicated his intention to appeal the ruling.
In a recent development, the Hague Court of Appeal issued conflicting reports regarding the mandatory rectification. During an emergency hearing, the court initially found Van Eikeren’s remarks—including calling Beelen a ‘hard-nosed speculator’—to be unlawful and without factual basis, with a decision on the social media rectification expected. However, subsequent reports indicated that the court has since ruled that Van Eikeren does not have to issue the rectification.
The Hague Court of Appeal has now officially overturned the previous judicial ruling in an expedited procedure. The court determined that Van Eikeren, representing the PRO party, is not required to retract his statements or issue a rectification regarding the insults and insinuations concerning Beelen’s business dealings and political bribery. Consequently, Van Eikeren is not obligated to pay legal costs.
