Spanish administrative and legal disputes
Overview
Legal proceedings in Spain have addressed various administrative and municipal issues. In Murcia, the Administrative Court No. 2 supported the Murcia City Council’s decision to allow Industrial Engineers to occupy positions designated for Industrial Technical Engineers, following a four year legal challenge by the Federation of Associations of Industrial Engineers of Spain. The Federation argued that Industrial Engineers possess the necessary qualifications to perform all functions required of Industrial Technical Engineers.
In the Bizkaia region, the Prosecutor’s Office archived investigations into allegations of “false municipal architects” in several Urdaibai municipalities. The investigation, which looked into claims of illegal appointments and usurpation of public functions, concluded that municipalities were working toward creating official civil servant positions for architects.
Additionally, the Spanish Supreme Court has admitted an appeal regarding a public contract dispute in A Coruña. The case involves a disagreement between the A Coruña City Council and a joint venture over price revisions for assisted living services. The court will examine whether contractors are entitled to compensation for increased energy and food costs to maintain economic equilibrium when services continue without a formal contract extension.
In Galicia, the High Court of Justice of Galicia (TSXG) ordered the Vigo City Council to pay 4,583,632.93 euros, plus legal interest and costs, to the Port Authority of Vigo. The ruling concerns the council’s failure to fulfill maintenance obligations under the 1992 Abrir Vigo al Mar agreement. The compensation includes costs for repairs the Port Authority had to fund, such as reconstructing an area that collapsed during the O Marisquiño festival in 2018. The TSXG rejected the council’s objections to the calculation procedure. Following the ruling, Luisa Sánchez, president of the People's Party in Vigo, criticized Mayor Abel Caballero, demanding explanations for the breach of duty.
