Tema housing development jurisdictional dispute

Overview

A jurisdictional dispute has emerged between the Tema Development Company Limited (TDC) and the Tema Metropolitan Assembly (TMA) regarding a housing project at Community One, Site Three in Tema.

The conflict intensified in early August after the TMA issued a stop-work order, citing concerns over unauthorized development, the demolition of structures, the felling of approximately 50 trees, and the encroachment on green belts and playgrounds. On August 12, the TMA task force demolished portions of the development following resident complaints. TDC described the demolition as “deeply regrettable,” noting it occurred before the response period for the stop-work order had expired.

The disagreement centers on statutory authority. The TMA maintains it holds planning and enforcement power under the Local Governance Act and the 1992 Constitution. Conversely, TDC argues it possesses an independent mandate to develop Tema based on the 1952 Tema Development Corporation Ordinance.

Following the escalation, President John Dramani Mahama summoned TDC Managing Director Courage Nunekpeku and TMA Metropolitan Chief Executive Ebi Bright to resolve the impasse. On August 28, 2026, the Office of the President intervened to clarify the mandates of both entities. In a formal letter, the Presidency affirmed that the TMA is the “highest political and administrative authority in the Tema Metropolis,” responsible for local planning and building permits. The Presidency characterized TDC Ghana Limited as a “commercially oriented real estate developer” rather than a municipal authority, directing both parties to coordinate to ensure proper municipal development.
