Thailand cryptocurrency ETF regulatory framework
Overview
The Thailand Securities and Exchange Commission (SEC) has finalized a regulatory framework for the establishment and listing of domestic cryptocurrency exchange-traded funds (ETFs). Scheduled to take effect on October 16, 2026, the initial rules focus exclusively on Bitcoin and Ether ETFs, which must be traded on the Stock Exchange of Thailand (SET).
Under the regulations, these funds must be passively managed and maintain an average net exposure of at least 80% of their net asset value to the underlying cryptocurrency throughout each accounting year. To ensure security, all assets must be held with digital asset custodians licensed by the Thai SEC.
To protect investors, the framework includes several restrictions: securities firms are prohibited from providing margin loans for ETF purchases, and retail investors are initially barred from accessing foreign crypto ETF-linked products through local brokers. Additionally, asset management companies must demonstrate adequate personnel and business systems, and investors must complete mandatory education and provide a formal acknowledgment of the risks associated with digital assets before trading.
As the implementation date arrives, the rules allow for the listing of Bitcoin and Ethereum ETFs to provide retail investors with regulated exposure to digital assets without direct ownership or storage requirements. However, market experts have expressed cautious expectations regarding demand. James Butterfill, head of research at CoinShares, indicated that early inflows are likely to be modest, potentially reaching only “tens of millions of dollars rather than the billions seen in other markets,” citing Hong Kong as a precedent for cautious initial demand.
