Overview

Poland’s competition authority, UOKiK, fined Bunge Polska more than 4.2 million zł for utilizing standard contract clauses that unfairly shifted the risks of force-majeure events, such as drought or frost, onto farmers. These clauses prevented producers from being exempt from liability when crops were destroyed by weather, potentially exposing them to penalties.

Bunge Polska, a subsidiary of a global agribusiness group, cooperated with the regulator, which led to a reduced settlement and the removal of the disputed clauses from its contracts. UOKiK President Tomasz Chróstny stated the intervention was intended to protect “vulnerable agricultural participants” and support food security interests in Poland.
