U.S. non-citizen voter registration errors and ICE data use

Overview

A federal review and analysis of official records have identified approximately 30,000 non-citizens who were mistakenly added to voter rolls across various U.S. states since 2000. These errors, occurring in states governed by both Democrats and Republicans, are attributed to administrative failures, such as software glitches and clerical mistakes during driver’s license processing. Specific findings include over 35,000 potential registrations in California and more than 10,000 in New York. In New Jersey, officials acknowledged 6,600 non-citizens on voter rolls, noting that roughly 400 had illegally cast ballots between June 2023 and June 2024 due to an automated system error. While some officials have characterized these findings as evidence of widespread fraud, experts noted in a Reuters report that the numbers are “too small … to impact elections” compared to the nation’s 170 million registered voters.

Internal documents obtained via Freedom of Information Act requests by Democracy Forward reveal that U.S. Immigration and Customs Enforcement (ICE) accessed more than 100 million voter registration records to identify potential non-citizen voters. This included 50.6 million records from the Department of Justice and 48.4 million gathered by a senior advisor to the Director of ICE and the Secretary of Homeland Security. By cross-referencing these with U.S. Citizenship and Immigration Services (USCIS) files, ICE generated over 1,500 investigative leads. Skye Perryman, president and CEO of Democracy Forward, described this as “an alarming attempt by the executive power to undermine our elections.”

Concurrently, USCIS data shows a sharp decline in naturalization approvals for the third quarter of fiscal year 2026, dropping to approximately 57,700 from previous highs. Meanwhile, the U.S. House Judiciary Committee has issued subpoenas to New Jersey officials regarding the state's registration errors.
