Overview

China is advancing strategic planning for its upcoming ‘Fifteenth Five-Year Plan’ period, with a significant focus on intellectual property (IP) and industrial modernization.

The State Council approved the ‘15th Five-Year Plan for Intellectual Property Protection and Utilization’ to address institutional shortcomings, accelerate legal reforms, and optimize the innovation environment. The plan seeks to strengthen the supply of high-quality IP, deepen reforms in rights distribution, and enhance technology transfer efficiency. It also aims to establish a professional workforce for IP management to support the development of ‘new quality productive forces’. Key objectives include building a ‘world-class IP powerhouse by 2035’ through 12 specialized projects targeting areas such as artificial intelligence and strategic emerging industries.

As part of the 2026–2030 planning cycle, China has unveiled a strategy to modernize its legal framework to support the digital economy. According to Liang Xinxin of the China National Intellectual Property Administration (CNIPA), the initiative will align with national development goals by focusing on scientific frontiers and high-quality economic growth. This includes tightening regulations for artificial intelligence, algorithms, blockchain technology, and large-scale data management, while strengthening copyright protections for AI-generated content, internet publishing, and audiovisual works.

To mitigate global legal risks as Chinese digital products like video games and web literature expand internationally, the government intends to establish a database for cross-border IP disputes and increase cooperation with the World Intellectual Property Organization (WIPO). By 2030, China aims to position itself as a global IP power, with a target for copyright-related industries to contribute 7.53 percent to the national GDP.

To support industrial modernization, the Ministry of Industry and Information Technology is implementing measures for small and medium-sized enterprises (SMEs). These initiatives focus on cultivating ‘specialized and innovative’ enterprises, accelerating digital and intelligent transformations, and establishing the second phase of the National SME Development Fund.
