Cologne deportation dispute expands to state scrutiny

Overview

The dispute over deportation enforcement in Cologne has escalated into a political scandal involving the potential intentional delay of removals for 471 individuals from the Western Balkans. A list sent in November 2024 by the Central Foreigners Office in Coesfeld identified citizens from Serbia, North Macedonia, Bosnia and Herzegovina, Albania, and Kosovo who were legally required to leave Germany. While Coesfeld offered assistance to secure temporary travel documents, Cologne authorities reportedly declined, stating no assistance was needed for 218 individuals who were being considered for residency prospects. Critics allege the city prioritized local residency programs over deportation obligations.

Following a request from the North Rhine-Westphalia Ministry of Migration, an investigation into Cologne’s ‘right-to-stay’ project revealed that several migrants with criminal records were included in the program. City Director Dörte Diemert reported that in 2024, 130 individuals in the program had criminal indications, with 79 having prior convictions. While 77 of these individuals have since been excluded—including 34 who received prison sentences exceeding six months—the review identified 29 cases where the reasoning for why certain individuals had not yet been excluded remained unclear.

State-level scrutiny remains high following data showing at least 12,000 active criminal investigations against individuals with deportation orders in North Rhine-Westphalia. The FDP has called for a complete reorganization of deportation practices, arguing that enforcement currently varies by “local postal codes rather than uniform law.”
