Delhi Parliament protest crackdown and legal proceedings
Overview
On July 20, a large demonstration organized by the Cockroach Janata Party gathered near the Parliament precinct in Delhi, breaching security barriers and confronting police. The police responded with lathi-charges and tear-gas, reporting significant injuries among both officers and protesters.
On July 25, Delhi police filed an FIR at the Kartavya Path Police Station including an attempted-murder charge under Section 109 (1) of the Bharatiya Nyaya Sanhita, alongside twelve other offences such as rioting and assault on public servants. Subsequent investigations released on July 29 used facial-recognition, drones, and CCTV footage to identify 2,873 participants, finding that 989 had prior criminal records.
In August, the Delhi Police filed a counter-affidavit with the Supreme Court denying allegations of excessive force. Deputy Commissioner of Police Sachin Sharma stated that police used “graded” and lawful force to manage a crowd of over 30,000 people, arguing that claims of brutality rely on “selective video clips and unverified social media reports.”
On August 18, the Supreme Court of India announced the establishment of a high-powered committee, comprising retired judges and former law enforcement directors, to investigate allegations of police brutality. The committee will examine the use of force, as well as allegations of sexual harassment and online victimization of female protesters. The court also indicated it may exercise extraordinary powers to consider quashing FIRs against student protesters. The clashes reportedly resulted in injuries to over 240 police officers and approximately 200 protesters.
