Her defense argued that she never received notice for her initial hearing. As a result of this decision, Seck is now eligible to apply for bond and is scheduled for a new immigration court appearance on November 20.

Despite this ruling, her legal team continues to pursue a federal habeas corpus petition in the U.S. District Court for the Western District of Kentucky to challenge the legality of her ongoing detention.
