Entre Ríos labor procedural reform proposal
Overview
The government of Entre Ríos, Argentina, has proposed a bill to reform provincial labor processes. The initiative aims to reduce litigation risks and costs for the business sector by strengthening due process guarantees and ensuring effective access to judicial reviews.
Key elements of the proposal include aligning the medical expert system with national labor risk legislation and establishing a specialized body of medical experts under the Superior Tribunal of Justice. The reform also seeks to decouple expert and judicial auxiliary fees from the economic value of lawsuits and remove the requirement for employers to deposit full judgment amounts or provide seizure assets to appeal convictions. The Unión de Aseguradoras de Riesgos del Trabajo (UART) has expressed support for the reform, citing a 38% increase in lawsuits between September 2025 and August 2026, noting that the measures are necessary to provide “predictability and objectivity to the system.”
However, the proposal has faced criticism from judicial representatives. María Gabriela López Arango, vice president of the Association of Magistrates of Entre Ríos, described the initiative as “partial,” arguing that it focuses too heavily on creating a body of independent medical experts with fixed remuneration rather than providing a comprehensive overhaul of the labor judiciary. López Arango also warned that eliminating the mandatory employer deposit in first-instance judgments could undermine the mechanism used to “ensure to some extent the certain collection of the worker.”
