Overview

The European Commission has intensified infringement proceedings against several member states for failing to transpose EU directives into national law.

Regarding anti-money laundering (AML) regulations, eighteen member states—including Spain, Germany, Greece, and Bulgaria—missed the July 10 deadline to implement the sixth directive. This directive aims to increase transparency regarding the beneficial ownership of companies to combat financial crime and terrorism financing. The Commission has issued formal letters of summons to these states, granting them two months to complete transposition.

In drug policy, several countries, including Bulgaria, Croatia, Cyprus, the Netherlands, Portugal, Romania, Slovenia, and Slovakia, failed to meet the July 12 deadline to incorporate three new psychoactive substances (2-MMC, NEP, and 4-BMC) into national drug definitions. The Commission noted that consumption of these substances has led to numerous deaths across Europe.

Portugal faces significant legal scrutiny. Beyond the drug policy and AML delays, the country is facing proceedings regarding the Right to Repair Directive, the Hydrogen and Decarbonised Gas Directive, and regulations on industrial and livestock emissions. Environmental organization Quercus reports that Portugal has 102 active infringement proceedings in Brussels, with approximately 35% related to environmental issues, energy transition, and climate action.

Bulgaria continues to face procedures regarding energy markets, hydrogen infrastructure, industrial pollution, and consumer rights. Member states have two months to respond to official warnings; failure to provide satisfactory responses may lead to reasoned opinions or referrals to the Court of Justice of the European Union for financial sanctions.
